All orders are custom and specially manufactured, and are not returnable for refund or exchange.


Terms of Payment

Sperlich Art Glass & Doors requires 50% non refundable down payment before proceeding with work on your custom order ( A non refundable Retainer for preparation of drawings (Designs) is required.) Payment in full is due upon completion of your order before shipment. If delivery is not concurrent with completion, notwithstanding, payment in full is expected upon completion, and not at the time of, or before delivery.

Terms of Freight

All shipments are F.O.B Miami Florida. We reserve the right to determine the best method of shipment. If Sperlich Art Glass & Doors ships a product C.O.D, payment must be made with a certified check. Credit cards may also be used for customer payment of shipping.

Limited Warranty for Wood and Aluminum Doors

Sperlich Art Glass & Doors Inc. warrants that all doors, sidelights and transoms sold under this warranty will be free of defects in materials and workmanship which would render them unfit for their ordinary use for a period of one (1) year from the date of purchase from Sperlich Art Glass & Doors Inc. subject to the limitations and exclusions contained herein. This warranty which is given expressly and in lieu of all other warranties, express or implied, including warranty of merchantability and fitness for particular purpose, constitutes the only warranty made by Sperlich Art Glass & Doors Inc. and covers only defects existing at the time of shipment by Sperlich Art Glass & Doors Inc. Because some states do not allow limitations on implied warranties, the above limitation may not apply to certain purchasers. In the event an appropriate court of law finds that the parties under this contract are bound by an implied warranty, the duration of such warranty shall not exceed one year, unless applicable state mandates otherwise. This warranty is extended only to the original retail purchaser who does not purchase for resale. All permits and legal requirements pertaining to local building codes are responsibility of customer.

Inspection

At the time shipment is received, all doors must be inspected within 24 hours of receipt. All visible defects must be reported to the manufacturer within 24 hours of inspection. Any freight damage must be reported within 24 hours of the inspection to the freight carrier. Any and all damage caused by shipment shall not be the responsibility of Sperlich Art Glass & Doors Inc. It is the responsibility of the buyer to file claims on all freight shipments and not that of Sperlich Art Glass & Doors. All visible defects or errors in shipment must be reported before the door is trimmed and hung.

Venue

This agreement shall be subject to and governed by the laws of the State of Florida. Any and all obligations or payments are due and payable in Miami, Miami-Dade County, Florida.

Liability

The manufacturer’s sole responsibility under warranty is as stated herein, and it shall not be liable for consequential, indirect or incidental damages, whether the claim is for breach of warranty or negligence. Any and all liability for defects or damage determined to be caused by Sperlich Art Glass & Doors shall be limited to the price of the product originally manufactured or sold by Sperlich Art Glass & Doors.

Attorneys’ Fees

Reasonable attorney and collection fees are to be paid to the prevailing party by the losing party when either party is required to take any action to enforce this contract. This provision shall include both the trial court and appellate court process.

Use of Pronouns

The use of the neuter singular pronoun to refer to the parties described in this agreement shall be deemed a proper reference even though the parties may be an individual, a partnership, a corporation, or group of two or more individuals, partnerships or corporations. The necessary grammatical changes required to make the provisions of this agreement apply in the singular sense as well as in the plural sense where there is more than one party to this agreement, and to either corporations, partnerships or individuals, males or females, shall in all instances be assumed as though in each case fully expressed.

Severability

If any provision of this agreement should for any reason be held violative of any applicable law, and so much of this agreement be held unenforceable, then the invalidity of such specific provision in this agreement shall not be held to invalidate any other provisions in this agreement, which other provisions shall remain in full force and effect unless removal of the invalid provisions destroys the legitimate purposes of this agreement, in which event this agreement shall be canceled.

Entire Agreement

This agreement represents the entire understanding of the parties hereto. There are no oral agreements, understandings, or representations made by any party to this agreement that are outside of this agreement and are not expressly stated in it.

Warranty conditions

If a defect is discovered or occurs after the door is hung, notice must be sent to the manufacturer with the original sales receipt within one year from the date of shipment. Notice received by the manufacturer one year to the day or more after the date of shipment will not be honored. The manufacturer, upon notification of said defect (s) and at his option, may: 1) Repair the defective door (s) ; or 2) Replace the defective door (s). Such repair or replacement shall not include any costs for taking down defective door(s), or shipping, finishing or handling of defective doors or new or temporary doors. All products are delivered unfinished from the manufacturer and have to be sealed on all sides after fitting/hanging. If doors are to be stored over five (5) days at a job site, all edges must be properly sealed. Damage resulting from doors not properly sealed are excluded from warranty.

Warp Tolerances

“Warp” is any distortion in the door itself and does not refer to the relationship of the door to the frame or jamb in which it is hung, the term warp shall include bow, cup, and twist. Warp shall not be considered a defect unless it exceeds 1/4 inch in the plane of the door itself. To determine the amount of warp present in a door, the following method of measuring shall be used: bow, cup and twists shall be measured by placing a straightedge, taut wire or string on the suspected concave face of the door at any angle ( i.e. horizontally, vertically, diagonally ), with the door in its installed position. The measurement of bow, cup and twist shall be made at the point of maximum distance between the bottom of the straightedge, taut wire or string and the face of the door.

Matters excluded from this warranty

1. Unsatisfactory service or appearance caused by failure to follow recommended handling care and finishing instructions;
2. All warp in which the doors measure the following:
a. all 1 3/4 thick doors which are wider than 3'0", or higher than 7'0", and/or
b. doors that are improperly hung or do not swing freely;
3. Damage caused by attempts at repair by unauthorized agents;
4. Any deterioration caused by failure to protect and seal all exposed surfaces of the door including sun and weather damage;
5. The appearance of field finished doors is not warranted in any event;
6. Natural variations in the color or texture of wood are not considered a defect;
7. Panel misalignment or shrinkage is not considered a defect.
If doors are found to contain defects not excluded by the warranty, the manufacturer may, at its option, either:
1. Repair the door(s), without charge, or,
2. Replace the door(s) without charge, in the stage of fitting and / or finishing as was originally supplied.
After appropriate notice is given by the purchaser, the manufacturer will perform its obligations under the warranty within 30 to 90 days.

Procedures to Insure Limited Warranty of Wood Doors

The procedure which the purchaser should follow in order to obtain performance of any warranty obligation is as follows:
1. If, at the time a door shipment is received, said door(s) is found to have a defect which can be reasonably discovered by inspection of each door(s), the purchaser MUST, prior to hanging or fitting, and within 7 days, send written notice of said discovered defect(s) to the manufacturer:
2. The manufacturer will not be liable for any door(s) that need repair or replacement without prior written notification by purchaser and prior written consent by manufacturer. Action on any claim for warp may be deferred, at the option of the manufacturer, for a period not to exceed 12 months from the date of claim. If a door has been installed prior to such claim being made, the door must remain hung in the original installation during the period of deferment to permit conditioning to humidity and temperature.

Instructions for Care and Handling

1. Do not cut doors down in width by more than ½ inch on each side, the collective cuts not exceeding more than 1 inch total. In height, do not cut doors by more than ½ inch on top, and not more than 1 inch on the bottom, the collective cuts not exceeding more than 1 &1/2 inches total. Use a sharp fine tooth saw for trimming ends of the doors;
2. Store flat, on a level surface in a dry, well ventilated area;
3. Doors need to adjust to the relative humidity of the area before hanging;
4. Doors should not be subjected to abnormal heat, dryness, humidity, or rapid temperature changes;
5. Doors that are to be stored at a job site, must be sealed on all edges, top and bottom, with a sealer or primer (oil base);
6. For best performance, any exterior door(s) should be installed under an overhang or with protection. If an overhang is not feasible, finishing the door in a light color will prevent excess heat build up in the door.

Instructions for Finishing

1. Immediately after fitting and cutting and prior to hanging any interior or exterior door, all surfaces and ends of the door MUST be sealed;
2. Before applying the first coat of finish, sand the entire surface lightly with 180 grit sand paper. This is to remove finger prints and handling marks;
3. Clean doors thoroughly after sanding to remove dust;
4. Make sure ALL SURFACES are properly sealed;
5. Stain and clear finish:
a. The first coat should be an alkyd resin based stain and sealer combination;
b. Apply at least two coats of clear top coat (oil base, alkyd resin base, polyurethane resin base);
c. Sand lightly between coats. Finishes should be applied in accordance with manufacturers directions, Use products from the same manufacturer to insure compatibility;
d. DO NOT use lacquer finishes for exterior use.
